This means that as people who very openly claim to be presenting their opinions (which we are) cannot be guilty of libel, as the definition of libel is "false or unjustified injury to someone's good reputation."

One of the key parts of being found guilty of libel is that the libelous act must be found malicious in intent.
"Malicious" meaning published with the understanding that the presented information is false, or with reckless disregard for whether the information published is false or not.

Mr. Parenteau has advocated for many children in special education helping his own child and countless parents secure free and appropriate services when the district failed to. I have worked across the country in almost every state doing Due Process and IEP cases over the past dozen years. I am quite appalled at the current state of crisis for children in special education in PUSD. I am distressed that the Administration seems to be playing a 'cat and mouse' game in which they pretend to be the mouse but are actually the Cat.
The article in yesterdays paper is enough to see that they refer to parents asking for help and needing it for their children as 'troublemakers', (to quote Kevin Kapp) but do not apparently own a mirror enabling them to take a gander at WHO is actually the problem. From my recent experiences and with the past record I can confidently state that they are the cause of the trouble and are costing the state and the taxpayers a large amount of money by not complying. To state in a public forum that this costs money and also mention a retreat they just went to is absolutely absurd. How much was the retreat? Why can't they just comply instead of letting their problems multiply and causing the state of AZ to at some point provide a large influx of children that will be adults with lifelong services? The answers to these questions seem to lay in the hands of two individuals. Reading that article lets anyone know who those two are.
I came upon PUSDinCRISIS.com several months ago and offered my advocacy services and help - I now see clearly that much must be done in Prescott. I have discovered that PUSD has had and extensive history of repetitive non compliance issues that goes back for many years. Most recently PUSD has had:
8 state complaints filed in which the school was found noncompliant.ADE/ESS State .
4 violations of I.D.E.A. 2004.
3 additional acts of non compliance with the states remediation demands.
DPC 09c-dp-09018-ADE - 3 more violations PLUS 4 more = 7 total violations
Sect. 504 ADA Title 2 complaint,
3 fed violations resulting in compensatory education
= 26 LEGAL ACTIONS WITH MORE COMING
I also have taken over as the Advocate in the cases for the parents Mr. Parenteau was helping. There is much work to do and it is our goal to NOT have what has happened to these parents happen to others. This action must stop! The Administration has the ability to stop it themselves but apparently need to be forced into stopping, this is unfortunate - for them and for the kids that suffer because of them.

On December 18th 2009 a member of PUSDinCRISIS.com, Mr.Ray Parenteau was arrested at gunpoint in an attempt to discredit him due to the ability he has in Advocating for children in Special Education. I have been working on the sidelines in assistance with some of these cases and will no longer do so. As I must come out boldly I ask that all parents with children in Special Education do the same if they are experiencing difficulties in obtaining programs or getting I.E.E.'s done. Any conflict/situation you have regarding a child in special education in PUSD should be brought forth as when we help one child, we are helping all that follow after them.
